• Agreeing with the following terms and conditions which are owned and operated by Adith IT business Pvt Ltd (OPC) is a prerequisite for signing up with the Vithai Application. You may use this Application services only in accordance with these terms and conditions. In the event of any conflict between these terms and conditions, you may not be able to use our services for that instant.
• Vithai Application (“Vithai”, “App”, “Application”, “our”, “we” or “us”) provides facility to sell and buy agricultural and its related products to all users. Please read our Terms of Service to understand your use of Vithai App. You agree to our Terms of Service (“Terms”) by installing, accessing, or using our apps, services, features, software.
• By using this Vithai app, you certify that you have read and reviewed this agreement and you agree to comply with its terms. If you do not want to be bound by the terms of this agreement,you are advised to leave this app accordingly. Vithai app only grants use and access to those who accepted its terms.
• Before you continue using this app, we advise you to read our privacy policy regarding our user data collection. It will help you better understand our practices.
• By using or accessing Vithai Application in any way, you are agreeing to be bound by these terms of service, all applicable laws, and regulations, and agree that you are responsible for compliance with the same. References in these terms to "we" are references to Vithai App and "you" as users of this Application.
• Linking this Application to any other Application and App requires prior consent of the Application owner.
• The decision to sign up with Vithai App is solely your choice. You cannot explore the features and functionalities of this App without signing up.
• Unauthorized usage of the Application is subjected to a criminal offense. Unless otherwise stated, all the contents of this Application including the data, text, graphics, images, symbols, logo, and workflow belong to Vithai Application except any image uploaded by the customer while making a post.
• Vithai login, password, email id, phone number, photos for the purpose of using our platform are needed for communication. Hence, the said requirements must be bonafide. These requirements are governed by the strict terms and conditions which have been provided under INFORMATION TECHNOLOGY ACT 2000.
• The application which has been created for the specific purpose should not be used for some other irrelevant purpose which is against law and procedure.
• If the user uses the application against the rules framed under the INFORMATION TECHNOLOGY ACT 2000, the platform owner has the rights to block the user and the transaction made by the user including taking illegal action as per INFORMATION TECHNOLOGY ACT 2000.
• You must be at least 18 years old to use our Services
• The authority shall not be responsible for information which is contradictory to the nature and characteristics of the product/produce furnished by the users of the Application.
• If the Application is misused the authority has the discretion to initiate legal proceeding against the concern.
• It is kindly noted that the sharing of the information pertaining to this produce must be useful and also healthy among the users of the application. In order to uplift the betterment of the user.
• The onus of verifying the genuineness of the information is on the person who is going to avail the information.
• In case it is found that any illegal information which is hazardous to health is begin furnished, the information will be verified by the authority and once for all will be blocked and will not be further allowed to use Vithai Application.
• You are responsible for the images uploaded by you and any concern regarding content or copyright violation. Vithai Application shall not be responsible for any inappropriate images/content.
• We shall not accept the images which fall under inappropriate category. Further details enumerated in Rejection Policy.
• The content including and not limited to graphics, images and text may not be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way, without the prior consent of Vithai App. However, you shall be entirely responsible for the images uploaded by you.
• You agree that you will not interrupt or attempt to interrupt the functioning of this App in any manner. As a restriction, you shall not use the Application for any purpose that is unlawful or prohibited by the terms of use.
• The Vithai application requires the producer (seller) to fill in details namely, the description, the quantity of product, its quality, the cost and an image of what the product looks like. The application merely acts only as a medium for purchase between the producer and the customer and Vithai app will not be responsible for the end product that the customer receives. The customer needs to ensure that the aspects of the product uploaded by the producer is genuine and the same as what the product actually looks like, quality, quantity, units, image, and the cost as well.
• Vithai app assumes no responsibility for liabilities related to age misrepresentation.
• As a user of this app, you may be asked to register with us and provide private information. You are responsible for ensuring the accuracy of this information, and you are responsible for maintaining the safety and security of your identifying information. You are also responsible for all activities that occur under your registered account.
• If you think there are any possible issues regarding the security of your account on the application, inform us immediately.
• We reserve all rights to terminate accounts, edit or remove content and cancel orders at our sole discretion.
• By visiting Vithai app, you agree with the laws and terms, without regard to principles of conflict laws, will govern these terms and conditions, or any dispute of any sort that might come between buyer and seller or its business partners or associates.
• Vithai app is not liable for any damages that may occur to you as a result of your misuse of our app.
• This application reserves the right to edit, modify, and change this agreement at any time. We shall let our users know all of these changes through updates.
• This agreement is an understanding between use and its affiliates and the buyer and the seller, and this supersedes and replaces all prior agreements regarding the use of Vithai app.

Use of contact number and chat

• Vithai App also requires users to give in their contact number during post. This is not mandatory and can be provided at the producer’s discretion. In case of any hesitation with regards to privacy and safety concerns, the producer can be accessed through the “Chat” option present in the application and this can be used as the medium of communication between both ends. The application will not be held responsible, in case any inconvenience that may occur on call or chat between the users. If users feel that either the customer or the seller is misusing and is misleading in any manner, then the user can send us an email regarding the same via E-mail : mailtovithai@gmail.com and further action will be taken from our behalf.
• Your messages are yours. We have built privacy, end-to-end We do not store your messages once they’ve been delivered. Neither us nor any third party can read them.
• We would advise you not to share your personal information in any case and we are not responsible for your messages.
• Any information shared and read through chat is completely your responsible. We shall not be responsible for damages to the properties, theft or any kind of security violation.

• This Vithai Application should not be used for any other purpose that is unlawful or illegal. This site should not be used for any other publishing, transmitting or promoting the details. You must understand, agree and acknowledge that you may be held responsible for above criminal, fraudulent, dishonest and injurious activities under criminal offenses.

Copyright and Trademarks

• The contents including graphics, design, style and every other matter related to the site are protected under applicable copyrights and intellectual property laws. All trademarks, logos and product names are proprietary to the owners and are protected under applicable trademark and copyright laws.
• You agree and acknowledge that you do not acquire ownership rights to any content, document or other materials viewed through the site except image uploaded by the customer and edited image delivered to the customer.
• Nothing contained on this Application should be construed as granting any license or right to use any of the contents displayed on the Application.
• Customers are the only copyright owners for their image while uploading in Post. We do not own any copyrights unless if the customers like to share their image with Vithai Application agreeing to the terms and conditions.

Disclaimers

• We do not provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information displayed. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
• We reserve the rights to correct all the errors and deletion if needed in any part of the app/application/site. We do not guarantee that the access to any part of this the app/application site will be error-free or uninterrupted.
• Permission must be granted by us for any type of link to this App. To seek our permission, write us to our e-mail id.

• Your uploaded Post in single post or bulk post will be rejected when against Religions, hurting particular group / people / race, using Pornography images, using inappropriate images or in conflict with the terms and conditions.
• If the image, sub categories, price, description about post and anything which makes nonsense relevant to Post we have all rights to reject to your post.

Changes and Updates

• We are committed to conducting our business in accordance with these principles in order to ensure that the confidentiality of personal information is protected and maintained. Vithai App may change this privacy policy from time to time at Vithai's sole discretion. Your continuous use constitutes your agreement to the privacy policy updates.

During pandemic

• When you are around other people, wear a mask that covers your nose, mouth, and chin.
• Keep a safe distance from buyer/seller.
• If you must meet buyer/seller, meet outdoors or choose open spaces with good air flow during buying or selling.
• Get vaccinated for further safety measures to avoid further complications.
• Vithai app is not responsible for the cause, if in case a buyer or seller is affected with corona during exchange of organic goods.
